By using our website or engaging our services, you agree to these Terms.
1. Services Overview
Fitscalez provides professional services including but not limited to:
- Full-stack web development (MERN Stack: MongoDB, Express.js, React.js, Node.js)
- Custom business website design and development
- Search Engine Optimization (SEO) — on-page, off-page, and technical
- Social media marketing and brand management
- Paid advertising (Google Ads, Meta Ads, LinkedIn Ads)
- Video production and commercial editing
- UI/UX design and Figma prototyping
- Email marketing campaigns
2. Engagement & Project Agreement
All projects are initiated upon mutual agreement between the client and Fitscalez. A formal project proposal, scope of work, and quotation will be provided before work begins. Key terms include:
- Project Scope: Clearly defined deliverables, timelines, and milestones as agreed in the proposal.
- Revisions: A reasonable number of revisions (typically 2–3 rounds) are included in the agreed project scope. Additional revisions may incur extra charges.
- Timeline: Standard websites are delivered within 2–3 weeks; custom MERN applications within 4–8 weeks (subject to scope complexity).
3. Pricing & Payment Terms
- All prices are quoted in Indian Rupees (₹ INR) unless specified otherwise.
- A 50% advance payment is required before project development begins.
- The remaining 50% balance is payable upon project completion, before final delivery and deployment.
- Payments can be made via UPI, bank transfer, Razorpay, or other agreed methods.
- Monthly retainer services (SEO, social media, digital marketing) are billed at the start of each billing cycle.
- All payments are non-refundable once work has commenced, unless otherwise stated in the project agreement.
4. Client Responsibilities
To ensure timely and successful project delivery, the client agrees to:
- Provide all necessary content, branding assets, images, and information in a timely manner.
- Review deliverables and provide feedback within the agreed timeframe (typically 3–5 business days).
- Provide access to required third-party accounts (domain registrar, hosting, Google Analytics, social media accounts, etc.) as needed.
- Communicate project changes or new requirements promptly.
5. Intellectual Property
- Client Ownership: Upon full payment, all custom-developed code, designs, and content created specifically for the client's project are transferred to the client.
- Fitscalez Ownership: Fitscalez retains the right to use general-purpose tools, frameworks, libraries, and reusable components developed internally.
- Portfolio Rights: Fitscalez reserves the right to showcase completed projects in our portfolio, website, and marketing materials unless the client requests confidentiality in writing.
- Third-Party Assets: Any third-party assets (stock images, fonts, plugins) used in the project are subject to their respective licenses.
6. Warranties & Disclaimers
- Fitscalez warrants that all work will be performed professionally and in accordance with industry standards.
- We provide 1 month of free post-launch support for bug fixes and minor adjustments after project delivery.
- We do not guarantee specific search engine rankings, traffic volumes, or conversion rates, as these depend on many factors beyond our control (market conditions, competition, algorithm updates).
- Our website and services are provided "as is" without any express or implied warranties beyond what is stated in the project agreement.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- Fitscalez's total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific project in question.
- Fitscalez is not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- Fitscalez is not responsible for downtime, data loss, or issues caused by third-party hosting providers, domain registrars, or payment gateways.
8. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the course of the project. This includes business strategies, technical specifications, client data, and any information marked as confidential. This obligation survives the termination of the engagement.
9. Project Cancellation & Refunds
- Either party may terminate a project with 7 days written notice via email.
- If the client cancels after work has begun, the client is responsible for payment of all work completed up to the cancellation date.
- Advance payments are non-refundable once development has commenced.
- Fitscalez will deliver all completed work and assets upon settlement of outstanding payments.
10. Website Usage Terms
By accessing fitscalez.com, you agree to:
- Use the website only for lawful purposes.
- Not attempt to gain unauthorized access to any part of the website, server, or connected systems.
- Not reproduce, distribute, or exploit our content, designs, or code without express written permission.
- Not use automated tools (scrapers, bots) to extract content, except as permitted by our robots.txt policy.
